Bisset cited an e-mail from Rick Williams, environmental services supervisor for the city, in which Williams "did not mandate or require any changes," indicating "he did not find any violations of our sanitary sewer discharge codes. Williams' e-mailed his findings to Thornton, copying his lawyer. "In our inspection of the current grease trap, it appeared the outer integrity of the box was still intact," Williams said. In the initial complaint, the owners of the popular downtown restaurant allege Thornton locked them out of the premises, forcing them to shut down without notice. He said it was carried out by 10:15, at which point Thornton was supplied with notice, but they were not allowed back in until 2 in the afternoon. He went on to say he had provided documents from city officials confirming that there had been no unlawful overflow into the sewer. In her April 26 letter, Walters alleged the city had determined the restaurant's grease trap was in violation of city ordinance and needed immediate repair. If the problem wasn't remedied by 5 p. Australia's staggered housing booms Today I want to try and add a whole new chapter to our understanding of Australia's $4 trillion housing market. The chart below illustrates the change in these raw median prices over time. While at first it is hard to make head or tail of the chart, if you look closely you are able to see apparent regime shifts in the state-wide capital growth rates: in particular, NSW, the ACT, and Victoria experience very robust dwelling price gains between 2000 and 2003, which, to varying degrees, stops or slows-down thereafter. With the above insights in mind, our research team has shown that about 96 per cent of the increase in median house prices in Australia between 1985 and today can be explained by changes in household borrowing capacity resulting from the long-term reduction in mortgage rates combined with the growth in family incomes (see first chart below). we have not even discussed the supply-side at this stage). Yet there appears to be another story to be told. Whereas in the decade 1990 to 1999 the highest state median price was, on average, about 200 per cent the size of the lowest, this differential soared to 321 per cent by the end of 2002. And, comfortingly, it has stayed around this level since 2006. One explanation for the phenomenon highlighted might be variations in income growth rates, and hence purchasing power, across the states. The chart also seems to suggest that, setting aside supply-side considerations, asset values did run ahead of income- and interest-rate linked fundamentals in the years after 2002-2003. The 41 per cent decline in home loan costs has, of course, enabled families to boost the amount of mortgage debt they are able to service for any given level of income. Indeed, as at December 2011, it was off a touch at 149. As night follows day, average variable home loan rates have also plummeted to 7. Importantly, it has not increased any further since this pre-GFC apogee - that is, for the last six years, housing credit has expanded at about the same rate as family incomes. The final chart demonstrates that the same dynamics in housing cost dispersion have asserted themselves even after deflating by state incomes: namely, a very large increase in the housing valuation gap from 1995 to 2002-2003, when the highest state price-to-income ratio was around 200 per cent the size of the lowest. That is to say, housing costs had converged to their pre-boom levels. The second replicates my earlier analysis by dividing the highest state ratio by the very lowest. We can try to address this issue by deflating state house prices by state disposable incomes. The red line tackles dispersion another way: it subtracts the difference between the highest and lowest state medians and then divides this number by the national median price. Irrespective of which measure one uses, the analysis shows us that house prices across Australia underwent an enormous break in the early 2000s fuelled by NSW, Victoria and the ACT, which was only remedied in the years after 2003 by catch-up growth across the other states. Between 1980 and 1995 inflation in Australia averaged 6. 7 per cent. Just as housing costs across this slab of the eastern seaboard started to freeze or slow-down, an even more striking boom was gathering momentum in the mining states of Western Australia, Queensland and the Northern Territory. Most readers should now be aware of the well-trodden explanation of what factors first drove the unusually sharp house price appreciation in Australia during the 1990s and 2000s. Dwelling prices in the Northern Territory also accelerate alongside Western Australia, albeit at a lower rate. Unsurprisingly, variable home loan rates also averaged an astonishingly - for anyone under the age of 35 - high 12. And by 1995, the value of total housing debt held by families divided by their disposable incomes was only about 55 per cent. Here again one sees another difference: while Queensland and Western Australia suffer house price falls during the GFC, which they claw back in 2009 and 2010, home values in the Northern Territory appear to keep appreciating during the crisis until they finally run out of steam at the end of 2009. To more precisely measure the time-series divergence in national housing costs I created two new benchmarks which are highlighted in the next chart. Average headline inflation has dropped 58 per cent from its 1980 to 1995 level to just 2. And so Australia's mortgage debt-to-household income ratio started rising from its 55 per cent level in 1995 to a peak of 156 per cent by 2006. House price inflation in Queensland, South Australia, and Tasmania step-ups with a lag, but, importantly, continues to kick-on after 2003, recording healthy capital growth right through to end 2007. |

Who wants to live in an overpriced dogbox looking right into someone else's dogbox anyway. Late last year developer Michael Yates took legal action to protect the ''million-dollar'' river views of his Claremont development in South Yarra after trying to buy the ''air rights'' of a neighbouring building. The developer had offered $250,000 to residents of 19 Yarra Street, a two-storey building next to Melbourne High School, for the ''airspace lot'' above their roof on the condition that they did not object to his development next door. They declined, saying their objections were not over the price of air rights, but because his proposed development would remove their own ''right'' to redevelop their block. The space above Ms Ong's art-deco neighbour is the sole source of light and fresh air for her apartment and the apartments of 48 other residents in her building. Ong knew the art deco building might be redeveloped one day and accepted it as a part of life in the CBD. It has embroiled them in a dispute with the developer that has cost them $25,000 so far. City of Melbourne planners, worried it would set a precedent, have rejected the draft plans. ''Sunlight is the very basic thing for all of us,'' she says. As Melbourne grows and grows. One day I'll move back there to enjoy it myself, . Greed, greed and more greed. ''Who would want to be staring at a neighbour 10 metres away and not have another room to go to, to look out at something else?'' the marketing executive says. It really does sound like people buying into the inner city high rise market are incredibly naive. The freshwater place stories are particularly ironic, given that it is there own building that extends to within 4 metres of the property line, and the proposed development is looking to do the same. He then subdivided that apartment into two lots: one with a horizontal boundary to the roof and the other to include all the airspace above the roof as well as an easement - or property right - for ''light and air'' that was in favour of the owners of his new development next door. ''There's only one buyer for the airspace rights and that's the adjoining owner,'' Yates says. The local council eventually approved the 26-storey Claremont apartment block. But experts say the battle for, and use of, air rights is likely to become more common as Melbourne continues to grow upwards and outwards. In Fitzroy, developers Neometro are building and selling a $15 million three-storey addition on top of the heritage-listed Panama House in Smith Street. Melbourne University planning expert Dr Alan March says Australia's planning system has long been subservient to individual property rights, but as development intensifies, planners will have to regulate decisions - such as air rights or rights to a view - that affect large numbers of people. As it stands, it's a case of buyer beware. But Melbourne Council planning committee member Ken Ong says residents do not have any ''right'' to a view. ''The capital city zone isn't an oversight, it's a deliberate intent - the designers of that zone didn't want objectors getting in the way of development,'' he says. ''They [developers] argue, of course, that people had the right to object when the zone was brought in, but the problem with that was that happened in the late '90s. Some city dwellers are now fighting back, and have launched a website campaign called residentswithoutrights. ''If you've got developers coming in and riding roughshod over the existing and planned guidelines, it's going to make residents and investors think twice about what might happen to the block next door to them,'' says Peter Renner. Architect Callum Fraser says that while tension aroundviews is difficult, the unfortunate reality is that people are relying on a view over somebody else's land. South of her one-bedroom unit is the roof of a two-storey art deco building, which is hemmed in on its other side by another high-rise. Many buildings have passages which receive no sunlight, and fresh air, which means electrical equipments and electricity are needed to supply artificial lighting and recirculate the air twenty four hours a day. But as the city mushrooms, the high-rise boom is pitting residents against developers in a system that residents say is skewed against them. Michelle Ong (no relation to Ken Ong) will not only lose ''borrowed'' views, but light and air too. If you buy in the city that says height limits are discretionary, you take the risk. He says the city council is about to finalise a 20-year plan setting out what varieties of buildings can be built where and how high they can go. The question many residents and planners are asking is how close can skyscrapers be to each other? Melbourne architect Callum Fraser says the key is how the neighbouring buildings are designed. ''There are many ways of achieving that sharing of light, views and ventilation and not necessarilyhaving 25-metre spaces between the buildings,'' Fraser says. He says the trend towards taller, narrower buildings on smaller blocks will make Melbourne more like an Asian city, which will require the government to be more flexible with planning controls. But Michael Smolders says he did all of the necessary research and that based on the present planning guidelines he knew any development of the neighbouring Queensbridge tower site couldn't be higher than 160 metres.
